On August 10 the Ninth Circuit rejected the platforms' attempt to reverse the ruling forcing them to face more than 3,000 federal suits. In June, Judge Kuhl refused to overturn the first plaintiff verdict, rejecting the argument that federal immunity or free speech protections block these claims.
Juries And Regulators Already Priced The Conduct
A Los Angeles jury awarded $6 million in K.G.M. v. Meta and YouTube in March, the first verdict of its kind. A New Mexico jury returned $375 million against Meta on state consumer protection claims. On August 26, Meta agreed to pay up to $16.7 billion to resolve state attorney general claims. None of the personal injury or school district claims are covered by that agreement.
